Terms of service

These are the terms between withsidekick and you, the business using it. Using the service means agreeing to them.
What the service does
We send review requests and follow-ups to the customers you tell us about, watch for new Google reviews, and draft replies for you to approve. On the free plan you send the messages yourself from your own phone and we send nothing. On a paid plan we send from a number registered to your business.
Your side of it — the part that actually matters
You are responsible for the people you add. By adding someone you are confirming that they are a real customer of yours, that they gave you their number in the course of doing business, and that they agreed to be contacted using the consent wording shown to you at the time. We record that wording verbatim against every contact for exactly this reason.
Do not upload a purchased list, a list scraped from anywhere, or numbers from people who have not hired you. US telemarketing law treats that as the business's violation, not the software's, and it is also the fastest way to get your number blocked by the carriers. If we see it, we will suspend the account.
You are also responsible for what your messages say and for honouring opt-outs — though we enforce STOP automatically, on every kind of message, and there is no way to switch that off.
What we will not do
We will not filter your customers by how happy they seem before asking for a review. Sending the review request only to people expected to leave a good one is against Google's policies and can cost you your listing. Nothing in this product does it, and we will not build it if asked.
Paying
Plans are billed monthly in advance through Stripe. Where a plan needs a registered sending number, the trial does not begin until the carriers approve that registration — so you are not paying for days you could not send on. Cancel any time from Billing; cancelling stops the next charge and does not refund the current month. Cancelling drops you to the free plan rather than deleting anything: you keep your customer list and your button.
We can change prices with 30 days' notice by email. A price change never applies to a month already paid for.
Uptime, and what happens when something breaks
We do not promise a particular uptime figure, and we would rather say so than print one we cannot stand behind. The service depends on Twilio, Google, Stripe and others, and when they are down, part of this is down. Messages are queued and retried rather than dropped.
What we are liable for is capped at what you have paid us in the previous three months. We are not liable for lost business, lost reviews, or a customer who reacted badly to a message you asked us to send.
Your data
Your customer list is yours. You can export it at any time and we will not use it for anything except running the service for you. What we store and for how long is in the privacy policy.
Ending it
You can stop at any time. We can suspend or close an account that breaks these terms — in practice that means sending to people who did not agree to hear from you — and we will tell you why. On closure you get a reasonable window to export your list.
The rest
These terms are governed by the law of the Commonwealth of Virginia. If we change them we will update this page and the date at the top, and email account holders when the change is significant. Questions go to support@withsidekick.ai.
